As for the law suit, it's not necessarily up to a jury. As a civil court case, you can choose to have a judge make the decision, which means you have someone more interested in technicalities than feelings. Works out quite often. Recently a guy sued two cops who wrote him a slew of tickets after he flicked them off. Not only was he wrongly pulled over (in that the tickets were bunk charges), but he won on the stance that his freedom of expression was violated.

There are many more things I can point out about government systems that are just wrong or funny, but that would be ranting.

Banned for I don't necessarily think America will be the last man standing, but France had a big ass revolution and was still around. England has held on something fierce. And Germany is a great example of a country that has been through a lot of turbulence, but still exists.
