I wondered if the DreadLords might be an exception to the invasion rule for spies, and it is.
I loaded up the DreadLord's passive spy box with spies, and then invaded and took their home planet.
The spies were lost, not returned to the pool.
That's a bug with all races in fact. Any passive spies that are placed get "lost" when a race ceases to exist. It's known by SD, it should be fixed in the next patch.
One caviat, they continue to dig up intel levels until they hit their max. I consider them archeologists though.

A related question: If a race has spies on your planets and that race ceases to exist, do the spies disappear?
Yes. Planetary spies work as intended.
It's just the passive spies that aren't working properly. For all I know, the race that dies' passive spies are still placed on you...but they do no harm, so it's non-issue.
Oops, I was asking about Dark Avatar, where there are no passive spies. Basically I've never had an AI spy on me for more thana turn, until now. I have about 8 and I assumed it was the Krynn, since i was at war withthem and they are the spy race. However they surrendered to me but the spies are still there. I was just wondering if they are left over Krynn that no one told that their government is dead (when the direct deposit of their pay stops they'll figure somethings wrong) or if they are from another race.

But in DA 1.8g, do AI spies stay on your planets after that race is gone?
No. Planetary spies, to my knowledge, have always worked properly in that once a race who owns the spies is gone, the spies go with them.
In my game, I have 57 spy on my worlds, but Its true that I dont feel that crippled since most of them belong to defeated races. My probleme is how do I know if I remove an effective spy from an undefeated race or juste wasting my money on an unemployed spy?
Since there is no way to tell spy origin, just get CEC's on all planets and pick off spies based on what they are placed on. Focus on econ/farm/morale buildings first to boost your income and thus amount of money you can spend on training each week.
