Ethical Choice in Battle of Gods?

Playing through the various scenarios in GCII, came across Battle of Gods, got a cool game going but realised from the start I couldn't choose an ethical alignment,even though I have every tech needed to do so (you can upgrade to Star Federation government on first go...). This rapidly became a huge problem as now every race has declared war on me, and teams have formed based largely on alignments. Is this an oversight in the scenario design, or did I miss something??

You can only pick your alignment when you just researched Xeno Ethics.

BTW.: In the Battle of Gods scenarion in DA you don't have the new techs (like Power Plants and the colonization techs) at the start.
