It was also included in Rome: Total War. Specifically, when the Egyptians demand that you become their protectorate. (which is kinda like a one-way submissive alliance)

does that happen when he's declaring war, does he say it out of the blue, or is that after the drengin AI wins?

In my current game, the altarans and the drengin are the most powerful AI civs, they're right next to eachother, and have been fighting the whole time. Every 3 weeks or so, some other race calls me up and asks me to give stuff to the losing side in that war, which changes frequently. It's like galactic gladatorial combat with everyone else as the spectator. I don't think anyone has noticed how well I have set myself up for the tech win this time.

No, sometimes they just talk trash. They are off the hook.

Sometimes I let them live just so I can get another random comment from them.

And big jim, this is all in "flavourtalk.xml". So feel free to add any suggestions you wish. My Drengin talk trash to me constantly. I've actually had someone walk into my room during a "wrong declaration of war" speech, and laugh their head off. I replaced it with the Black Knight's lines.
