Computer AI Steals Tech?

I noticed one, lets call it computer AI problem. As I finished off the terrans, that left the torians (all others were elimated including minors). so I had 5 turns for a culture win and we all know I was going to declare war. So before I declare I went into the political screen, talked to the leader to not only see if I could threaten (which would be a nice add on), but to see what tech I could trade him and see how far behind me he was. The best weapon he had was harpoon II (as it offered me to trade him harpoon iii and up). I was on Photon III almost to anti-matter torps.
After going to war and ripping through his first fleets, by the 3rd turn his ships were equipped with photon torps. I was kinda mad. I won anyway but how is that possible?? I know espionage is a possibility, but for him to take the one tech that could keep the ai in the game was odd to me. Perhaps some anti-espionage would be nice, but im open to ideas or how can one track this?
Any thoughts?
